Washington, DC – A Republican slanted federal appeals court on Friday ordered the dismissal of a pending ACLU lawsuit challenging President Bush’s domestic spying program, saying the plaintiffs had no standing to sue.

The gist of the court’s ruling: The plaintiffs can’t sue because they can’t prove that their communications were or would be intercepted, because under the State Secrets Act the government doesn’t have to tell them whether their communications were or would be intercepted. Nice arrangement for the government.
